America’s Senior Need Affordable Energy – Not Reckless Lawsuits

America’s seniors support common sense, and the commonsense approach that will secure the country’s global energy dominance is an all-of-the-above policy. This is why the 60 Plus Association has launched a campaign calling for Kansas Attorney General Kris Kobach to end his reckless lawsuit forcing divestment from the coal industry, ultimately hindering access to affordable energy for seniors.

Over the last few decades, the shift to natural gas in the United States has made affordable, abundant, and reliable energy more accessible for all Americans. President Trump has led the charge, reducing regulatory burdens around energy production and promoting energy exploration, which has already driven down energy prices for consumers tremendously. This is particularly important for seniors who, far too often, are left to pay more for energy than their younger counterparts, with little ability to reduce their costs.

Not insignificantly, this change from coal to natural gas has saved consumers $1.6 trillion, or about $3,500 in savings per household. In 2023, the growth in domestic gas production, when combined with increased storage levels, caused energy prices to decline by 60 percent. This has greatly impacted seniors, who are more likely to stay at home longer for health reasons, or have higher energy consumption habits generally.

The unleashing of American energy – which has only accelerated under President Trump’s American Energy Dominance agenda – provided seniors with economic relief. However, a lawsuit led out of Texas is standing in the way of President Trump’s agenda and will cause seniors to once again shoulder a significant economic burden.

In November 2024, eleven Republican Attorneys General, including Kansas Attorney General Kris Kobach, filed a lawsuit accusing major asset managers of using their holdings in coal companies to force a reduction in coal output by 2030. The attorneys general argue asset managers, through their involvement in climate initiatives, colluded to constrain coal supply, leading to higher energy costs for Americans. While there is agreement that political agendas should not influence investment strategy, the reduction in coal production was well underway in the United States with natural gas production overtaking coal as it proved to be more cost effective.

This lawsuit not only stands in the way of President Trump’s energy agenda, but it will also be detrimental to the American coal industry by starving it of much needed capital. One of the solutions proposed in the lawsuit is to have the asset managers divest their holdings in coal companies – which may delay or terminate the necessary energy infrastructure development and modernization needed across the country.

Attorney General Kobach and the ten other GOP attorneys general who signed onto the suit must understand the broad implications of their actions on Americans, and, most importantly, on seniors. Across Kansas, seniors have benefitted from the change in energy source, with the average electricity bill decreasing over 9 percent between 2022 and 2023. President Trump will only continue to help lower costs for consumers through his promotion of common-sense energy policies that foster a competitive and stable energy market and lead to American energy dominance. This lawsuit runs counter to that.
